Shouldn't 
    // tm:subject[. isa tm:subject]
return the same result as 
    // tm:subject
?

If I understood TMQL/TMRM correctly, a proxy (tm:subject) is an instance of 
itself.

True, but tm:subject is only a concept and does not exists in the topic map in

IMO it doesn't matter if tm:subject is physically part of the topic map. The 
TMQL semantics should be respected even if tm:subject doesn't exists
