Overview

Tektite is licensed under the Business Source License (BSL) with the following exceptions:

  • Files in the 'asl' directory and sub-directories are licensed under the Apache Software License Version 2.0
  • Files in the 'client' directory and sub-directories are licensed under the Apache Software License Version 2.0
  • Files in the 'mit' directory and sub-directories are licensed under the MIT License

Licensor:             SpiritSoft Limited, UK
Licensed Work:        The Licensed Work is Tektite (c) SpiritSoft Limited.

Additional Use Grant: You may make use of the Licensed Work, including
production use, provided that you do not use the Licensed Work to create an
"Event Streaming or Processing Platform".
An "Event Streaming or Processing Platform" is a commercial product or service
that allows third parties (other than your employees and contractors), to perform
actions that result in the creation of streams or topics in the Licensed Work.

Change Date:          Four years from the date the Licensed Work is published

Change License:       Apache Software License 2.0

Terms

The Licensor hereby grants you the right to copy, modify, create derivative
works, redistribute, and make non-production use of the Licensed Work. The
Licensor may make an Additional Use Grant, above, permitting limited
production use.

Effective on the Change Date, or the fourth anniversary of the first publicly
available distribution of a specific version of the Licensed Work under this
License, whichever comes first, the Licensor hereby grants you rights under
the terms of the Change License, and the rights granted in the paragraph
above terminate.

If your use of the Licensed Work does not comply with the requirements
currently in effect as described in this License, you must purchase a
commercial license from the Licensor, its affiliated entities, or authorized
resellers, or you must refrain from using the Licensed Work.

All copies of the original and modified Licensed Work, and derivative works
of the Licensed Work, are subject to this License. This License applies
separately for each version of the Licensed Work and the Change Date may vary
for each version of the Licensed Work released by Licensor.

You must conspicuously display this License on each original or modified copy
of the Licensed Work. If you receive the Licensed Work in original or
modified form from a third party, the terms and conditions set forth in this
License apply to your use of that work.

Any use of the Licensed Work in violation of this License will automatically
terminate your rights under this License for the current and all other
versions of the Licensed Work.

This License does not grant you any right in any trademark or logo of
Licensor or its affiliates (provided that you may use a trademark or logo of
Licensor as expressly required by this License).

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE LICENSED WORK IS PROVIDED ON
AN “AS IS” BASIS. LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS,
EXPRESS OR IMPLIED, INCLUDING (WITHOUT LIMITATION) WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND

What is the motivation for using the BSL?

In recent years there have been multiple cases where large companies have created hosted SaaS versions of popular open source projects and competed directly with similar offerings provided by the creators of the open source project. We believe that open source creators should be able to monetise their offerings without fear of being undermined by large organisations who can use their economies of scale to provide competing offerings, and often do not contribute back to the open source communities.

Who else uses the BSL?

Some well known products/companies that use BSL include:

  • CockroachDB
  • RedPanda
  • ElasticSearch
  • MariaDB
  • Sentry
  • Couchbase
  • HashiCorp (Terraform, Vagrant etc)

Can I host Tektite as a service for internal use in my company / organisation ?

Yes, as long as it is only used by your employees and/or contractors. You won't be able to expose the service outside your company / organisation without a commercial licence from SpiritSoft.

Can I use Tektite as part of my product that is only used internally in my company / organisation?

Yes, you can.

Can I use Tektite as part of my own product or hosted service that is exposed to the general public?

Yes, as long as your service is not an "event streaming or processing platform". An "event streaming or processing platform" allows third parties to perform actions that result in the creation of streams or topics in Tektite.

For example, if you were creating a financial SaaS offering and used Tektite internally, that would be fine.

How does the Tektite BSL License differ from a permissive open source license.

The Tektite BSL allows use similar to most permissive open source licenses with the added restriction that you cannot use it to create an "event streaming or processing" platform product or service which is exposed outside your company / organisation without a commercial licence.
